ROSENDALE TOWN BOARD SPECIAL MEETING                   DRAFT

PUBLIC HEARING LOCAL LAW #2, 2010 DOG LICENSING

DECEMBER 20, 2010

 

The meeting was called to order at 6:30 pm by Supervisor McDonough at the Rosendale Community Center with the Pledge to the Flag.

 

            PRESENT:       Councilman Robert Gallagher (arrived 6:35 pm)

                                    Councilwoman Manna Jo Greene         

                                    Councilman Kenneth Hassett (arrived 6:35 pm)

                                    Councilman Richard Minissali   

                                    Supervisor Patrick McDonough

ALSO PRESENT:       Highway Superintendent Carl Hornbeck,

 

1). PUBLIC HEARING: A public hearing for the purpose of enacting Local Law #2 of the year 2010 was opened with the reading of the Notice of Public Hearing by the Town Clerk.  There was no one present to make comment on the proposed local law, the Town Board had a short discussion and review of the content of the proposed local law; Supervisor McDonough then stated that he would hold the hearing open and move on to other matters.

 

2). RESOLUTION 12-2010-#10 Supplemental Agreement to the Town of Rosendale Municipal Service Contract for the Rosendale Park & Ride.

A motion was presented by Supervisor McDonough to adopt the resolution to authorize the Supervisor to sign the supplemental agreement for the Park & Rides Contract; seconded by Councilman Minissali.  Roll Vote:

3). RESOLUTION 12-2010-#11 Seeking Sealed Bids for Purchase and Removal of Scrap Metal.  The Town is desirous of seeking bids for the purchase and removal of scrap metal at the Transfer Station which will increase the revenue to the Town; prices per ton have increased since the last removal.  The sealed bids will be opened publicly at noon on January 4, 2011 at Town Hall; the resolution authorizes publishing of a request for sealed bids.

A motion was presented by Supervisor McDonough to adopt the resolution seeking sealed bids for scrap metal purchase and removal; seconded by Councilwoman Greene.

4). RESOLUTION 12-2010-#12 Purchase of Plow Package for Town Truck.  A resolution was presented to purchase a plow package for the 2011 Ford F450 recently acquired by the Highway Department; Albany Avenue Garage in Kingston is the sole provider in our area for the standardized Boss equipment; the price is $6,325.00 less a trade in of $2,000.00 leaving the total cost at $4,327.00.

A motion was presented by Supervisor McDonough to adopt the resolution authorizing the purchase of a snow plow system for the Highway 2011, Ford F450 truck from Albany Avenue Garage in Kingston for $4,327.00; seconded by Councilman Hassett.

Councilwoman Greene initiated discussion about enacting a moratorium on cell tower siting (related at this time to Cellco/Verizon application in Tillson); Supervisor McDonough responded that he had spoken with the attorney for the town and there is no valid reason to enact a moratorium; the residents of Davis Road can pursue their own law suit against Cellco and the Town if the wish.  Councilman Hassett stated that for the Town to pursue a moratorium at this time would sound like “sour grapes” for not siting on Town owned property; if the existing Code allows the siting then “so be it”; Council-woman Greene said that we should check with the Comprehensive Plan also.

 

A motion was made by Supervisor McDonough to close the public hearing on the proposed Local Law #2 of 2010 regarding amending Town Code for Dog Control and Licensing at 7:01 pm; as there were no comments presented; seconded by Councilman Gallagher.  Roll Vote:  5 Yeses.

 

5). RESOLUTION 12-2010-#13 Adoption of Dog Control Local Law.  The Local Law authorizes the Town Board to make amendments to the existing Code and add Article III setting forth licensing requirements and fees.

A motion was presented by Supervisor McDonough to adopt the resolution enacting Local Law #2 of 2010 related to Dog Control; seconded by Councilman Gallagher.     Roll Vote:

A motion was made by Councilman Hassett to pay the bills; seconded by Councilwoman

Greene.  Roll Vote; 5 Yeses.

 

A motion was made by Councilman Minissali to adjourn at 7:10 pm; seconded by Councilman Gallagher.  Roll Vote: 5 Yeses.
